It is alleged that respondent no.4 Smt. Mutaha Begum is still in possession of Plot No. 53/228 (area 0.028 hectare) and in this regard she has also made a statement on affidavit despite that the Tehsildar on account of local politics and animosity lodged the impugned FIR against the petitioner mala fidely.
Issue notice to respondent nos. 3 and 4 through registered post with AD returnable within six weeks. Steps to be taken within a week.
Learned Additional Government Advocate appearing for the State- respondents no.1 and 2 prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed, within two weeks thereafter. List thereafter.
Considering the submissions and looking to the facts of the case, in the meanwhile, it is provided that the petitioner shall not be arrested in Case Crime No. 244 of 2007, under Section 198 (A) 2 of U.P.Z.A. & L.R.Act, 1950, Police Station Sarsawa, District Saharanpur till submission of report or until further orders of this Court whichever is earlier provided he cooperates in the investigation and appears before the Investigating Officer as and when required.
