HIGH COURT OF JUDICATURE AT ALLAHABAD
Criminal Misc. Writ Petition No. 12806 of 2007
Sherpal Vs. State of U.P. and others
Hon'ble S. Rafat Alam, J.
Hon'ble V.D.Chaturvedi, J.
We have heard learned counsel for the petitioners and the learned standing counsel for the State-respondents and also perused the impugned FIR.
The allegation made in the FIR prima facie discloses commission of cognizable offence and, therefore, we are not inclined to quash the same or to grant any relief to the petitioner at this stage. However, looking to the facts of the case and considering the submissions made before us it is provided that in the event the petitioner surrenders before the court concerned and moves an application for being released on bail in Case Crime No. 283 of 2007, under Sections 147, 149, 332, 336, 353 and 427 IPC, Police Station Barsana, District Mathura, the same may be considered and disposed of expeditiously.
With the aforesaid observation, the writ petition is dismissed.
