We have heard learned counsel for the petitioners, learned standing counsel for the State-respondents and Sri S.K.Srivastava, learned counsel appearing for the complainant and also perused the impugned FIR.
The allegation made in the impugned FIR prima facie discloses commission of cognizable offence and, therefore, the same cannot be interfered with at this stage.
The writ petition is, accordingly, dismissed in limine. It would, however, be open to the petitioners to apply for bail before the court concerned in Case Crime No. 126 of 2007, under Sections 363,366 and 376 IPC, Police Station Shivli, District Kanpur Dehat.
