None appeared in support of the writ petition on the repeated calls. We find from the record that a civil suit filed by the petitioners is already pending, in which the applications moved by the petitioners were rejected and physical possession of the industrial unit has been taken and sale has occurred without any public auction, which, according to the petitioners, has been done against the guidelines of the Supreme Court. However, the writ court is not the appropriate forum for the purpose of interference with the matter when not only the civil suit is pending but the written statement has also been filed by the State Financial Corporation. Therefore, the writ petition stands dismissed. Interim order, if any, stands vacated.
No order is passed as to costs.
However, passing of this order will no way affect the right of the petitioners to take any ground before the civil court, where the suit is pending.
