Two revisions - one by the Gaon Sabha and one by the petitioner were filed before the Dy. Director of Consolidation which were allowed by the Dy.Director of Consolidation by the order dated 11.6.07. Against that order a restoration application was filed by the Gaon Sabha. In the said restoration application the Dy. Director of Consolidation has directed issuance of notice and has stayed the operation of the order passed in the revision. Sri R.C.Singh counsel for the petitioner submitted that the Gaon Sabha is really not aggrieved by the order of the Dy.Director of Consolidation and in fact its revision has been allowed by the Dy. Director of Consolidation. The restoration application is still pending before the Dy.Director of Consolidation. It is open to the petitioner to raise before him this or any other objections to the maintainability of the restoration application or on merits. The Dy.,Director of Consolidation shall consider the same and pass appropriate orders expeditiously in accordance with law after opportunity to the parties concerned. No ground for interference in extra ordinary jurisdiction is made out. With these observations, the writ petition is dismissed.
