Heard learned counsel for the plaintiff-petitioner.
It transpires that an exparte interim injunction order was granted in favour of the plaintiff. However, on contest the interim injunction was vacated by the trial court by an order dated 14.3.2005 against which the plaintiff preferred an appeal which was also rejected. Consequently, the writ petition.
A categorical finding has been given that the appointment of the plaintiff as a Pujari of the temple had been set at naught by the new Management Committee which has not been disputed by the plaintiff. Consequently, the court was justified in vacating the exparte interim injunction granted in favour of the plaintiff. No case for interference is made out in the writ jurisdiction. The writ petition is dismissed.
Since the suit is of the year 2001, I direct the trial court to decide the suit within one year from the date of the production of a certified copy of this order.
