1. Heard Mr. C. B. Yadav, learned counsel in support of this appeal, Mr. G.C. Upadhyaya appears for the respondents.
2. The appellant is working as Constable in Civil Police. He has been transferred from Civil Police to Government Railways Police, which is also a section of the State Police department. The appellant has challenged this transfer by means of writ petition, which came to be dismissed and therefore this appeal.
3. Before we examine the submissions made by learned counsel for the appellant, we are of the view that the appellant must join at the place where he has been transferred. Mr. Yadav submits that the appellant will join at the place where he has been transferred and also undertakes to file an affidavit to this effect.
4. The matter will now be listed on 6th September, 2007, along with the records of (defective) Special Appeal No. 935 of 2007, decided on 17th July, 2007, wherein the identical controversy has been dealt with by Division Bench of this Court.
