Heard Sri S.K. Yadav holding brief of Sri Anuj Kumar, learned counsel for the respondent no.3.
The petitioners were allotted some land. The application under Section 198 (4) of U.P. Zamindari Abolition and Land Reforms was filed by the respondents for cancellation of the allotment. The application was dismissed by the Collector but revision against the order filed by the respondents was allowed. The petitioners filed revision before the Board of Revenue, which has been dismissed. The finding is the the disputed land was a pond/bhita and covered under Section 132 of U.P. Zamindari Abolition and Land Reforms Act and it was let out for tree plantation, which is not permissible. The allotment itself was, therefore, illegal. The finding appears to be correct. No grounds for interference in extraordinary jurisdiction under Article 226 of the Constitution of India has been made out. Dismissed.
