Dr. Prakash Chandra Upadhyay v. State Of U.P. & Others - WRIT - A No. - 21362 of 2001 RD-AH 14753 (31 August 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Amitava Lala, J.
Hon'ble S.P. Mehrotra, J.
In view of the availability of alternative remedy under the U.P. Public Service (Tribunal) Act, 1976, we are of the view that the writ petition can not be said to be maintainable directly before the writ jurisdiction in the manner it has been made. Hence, the writ petition stands dismissed. Interim order, if any, stands vacated.
No order is passed as to costs.
However, passing of this order will no way affect the right of the petitioner, if any, to proceed before the appropriate tribunal in accordance with law.
