Unless ordered otherwise, for a period of six months petitioner shall not be evicted from the accommodation in dispute in pursuance of impugned orders provided that with effect from September 2007 onwards he pays rent to the landlord respondent @ Rs.1750/- per month by 7th of each succeeding month.
In case of two defaults, stay order shall stand automatically vacated. Non payment of this amount may also be a ground for dismissal of the writ petition.
It is further clarified that suit for eviction has also been instituted by the landlord respondent against tenant petitioner. In case eviction decree is passed in the said suit then this stay order shall not be treated as stay of dispossession in pursuance of the said decree. Enhanced rent of Rs.1750/- per month shall be deposited before JSCC Kanpur in SCC Suit No. 61 of 2005 and shall immediately be paid to the landlord.
