Santosh Kumar Yadav v. Vice Chancellor, Banaras Hindu University And Others - WRIT - A No. - 39679 of 2007 RD-AH 14797 (31 August 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Vineet Saran, J.
Sri K.K.Rai, learned counsel for the respondent-University has raised a preliminary objection that the petitioner has an alternative remedy of filing an appeal against the order impugned in this writ petition. Learned counsel for the petitioner does not dispute the aforesaid position but states that this writ petition may be entertained.
Having heard learned counsel for the parties and considering the facts and circumstances of this case, I am not inclined to interfere in this writ petition on the ground of petitioner having an alternative remedy which has not been availed by him.
Accordingly, this writ petition is dismissed with the observation that the petitioner may avail such other remedy available under law.
