Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that there is a cross version of the alleged incident. From both side F.I.R. have been registered. Both sides received injuries. From the side of the applicants one person lost the life and one person lost the life and two persons lost their lives and from the side of the prosecution four persons sustained injuries, which have not been explained. The prosecution has not come with clean hands. The co-accused Chhangey whose was on the same footing has been released on bail on 6.12.2006 in criminal misc. bail application no. 26741 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Ram Gopal and Santosh Kumar involved in case crime no. 809 of 2006 under Sections 304,324,323,504 I.P.C., P.S. Pooranpur District Pilibhit be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
