It is alleged that the allegation does not constitute any cognizable offence. It is further submitted that the dispute pertains to civil nature.

Learned Additional Government Advocate appearing for the State- respondents prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed, within two weeks thereafter. List thereafter.

Considering the submissions and looking to the facts of the case, in the meanwhile, it is provided that the petitioners shall not be arrested in Case Crime No. 43 of 2007, under Sections 419, 420, 467, 468 and 471 IPC , Police Station Naraini, District Banda till submission of report under Section 173 of Cr.P.C. or until further orders of this Court whichever is earlier provided they cooperate in the investigation and appear before the Investigating Officer as and when required.
