Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is the uncle in law of the deceased. The marriage of the deceased was solemnized about two and half year prior the alleged incident. The cause of death could not be ascertained, hence the viscera was preserved. The applicant is separately living. He was having no concerned with the family affairs of the deceased and her husband. The case of the applicant is distinguishable with the case of other co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ramesh involved in case crime no. 362 of 2006 under Sections 498-A,304 B I.P.C., and 4/3 D.P.Act P.S. Sadar Bazar District Agra be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
