The learned counsel for the petitioner submits that the similar issues have bee raised in the writ petition No. 22658 of 2007 Salora International Ltd. versus State of Uttar Pradesh & others in which this Court has granted interim order on 11.5.2007. The counsel for the petitioner contends that the petitioners are paying wages to the workman of respondent No.4 which are morel than minimum wages and the amount paid by the petitioner is more than minimum wages + VDA.

Considering the submissions and the facts of the present case, following the interim order dated 11.5.2007 passed in the aforesaid writ petition , it is provided that the effect and operation of Government order dated 21.2.2007 as circulated vide letter dated 28.2.2007 shall remain stayed. However, this interim order shall not benefit the petitioner in the event the higher minimum wages (including the basic wages plus dearness allowance) paid by the establishment falls below the minimum wages and VDA notified by the State Government.
