Ajai Kumar Verma v. State Of U.P. Thru' Secy. Min. Of Home & Ors. - WRIT - C No. - 41933 of 2007 RD-AH 15057 (6 September 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Janardan Sahai,J
The grievance of the petitioner is that his bus has been sold in execution of an order passed by the Workmens' Compensation Commissioner. The petitioner filed objection under Rule 285-I of the U.P.Zamindari Abolition & Land Reforms Rules before the Commissioner which has been rejected. Counsel for the petitioner submitted that there was a stay of the order of the Workmen's Compensation Commissioner by the High Court and that order has been misread by the Commissioner. In my opinion the question raised by the petitioner does not arise because objections under Rule 285-I of the U.P.Zamindari Abolition & Land Reforms Rules were not maintainable. The reason is that under Section 282 of the U.P.Zamindari Abolition & Land Reforms Act, the attachment and sale of moveable property shall be made in accordance with law in force for attachment and sale of moveable property in execution of a decree of the civil court. The objections under Rule 285-I of the Rules are maintainable only in respect of immovable property. In view of the fact the objections themselves were not maintainable no ground for interference under Article 226 of the Constitution of India has been made out. Dismissed.
