To give effect to an order of the Consolidation Officer dated 28.5.1985 a reference was prepared and in the said reference the petitioners' chak has been affected. Learned counsel for the petitioners submitted that the order dated 31.3.2003 was passed without hearing the petitioners. The petitioners filed a restoration application, which has been dismissed with the finding that the petitioners have been heard. The finding is one of fact. It has also been found that the allotment has been made on the original number of the petitioners a fact, which is not challenged by the petitioners.
Counsel for the petitioners submitted that the plot nos. 393 and 1258, which have been allotted to the petitioners are in the shape of pond. No material, however, has been filed by the petitioners to support the contention. In the absence of any
material having been referred to the argument has no merit. The petitioner has been allotted chak on original numbers. Dismissed.
