Bhullan v. Board Of Revenueu.P. At Meerut & Others - WRIT - B No. - 41731 of 2007 RD-AH 15067 (6 September 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Janardan Sahai, J.
A suit under Section 229-B of U.P. Zamindari Abolition and Land Reforms Act was filed by the petitioner, which has been dismissed by the trial court. The order was affirmed in appeal and by the Board in revision. The finding is that the petitioner did not adduce any evidence in proof of his title although several dates were fixed. It appears no oral evidence was even led by the petitioner. There is no challenge to the finding that the petitioner did not adduce any evidence. Certain khatauni extracts have been sought to be filed along with the writ petition but they are not a part of the record of the courts below. In the absence of evidence the courts below did not commit any illegality in dismissing the suit. There is no merit in this petition. Dismissed.
