The petitioner has filed a suit under Section 176 of U.P. Zamindari Abolition & Land Reforms Act. The suit was dismissed and the revision filed against that order was also dismissed. The finding is that in consolidation proceedings a separate chak was allotted to the petitioner. It is conceded by the petitioner's counsel that there is no co-tenant along with the petitioner in the disputed plot which was the subject matter of the suit under section 176 of the U.P. Z.A. & L.R. Act. In the circumstances the suit for division of holding was not maintainable. No ground for interference has been made out. Dismissed.
