Pursuant to the order dated 11.1.2007, the case is listed today.

Sri D.S.P. Singh, learned counsel for the defendants -appellants and Sri Sidharth Verma, learned counsel for the defendant-respondent no. 2, are present.

Sri Sidharth Verma, learned counsel for the defendant-respondent no. 2 states that Counter Affidavit in reply to Civil Misc.  (Restoration ) Application No. 174849 of 2006 and Civil Misc. ( Delay Condonation ) Application No. 174852 of 2006 filed on behalf of the defendants  -appellants , has been filed in the Registry on 17.1.2007. The said Counter Affidavit is not on record.

Office is directed to trace the same, and place it on record.

By the order dated 23.11.2006, it was , interalia, directed that copy of the Supplementary Affidavit, sworn on 30.9.2006, would also be sent along with the notice.

Sri Sidharth Verma, learned counsel for the defendant-respondent no. 2 states that along with the notice, copies of the aforementioned applications were received but copy of the aforementioned Supplementary Affidavit was not received. He further states that he has received today, copy of the aforementioned Supplementary Affidavit.

Sri Sidharth Verma, learned counsel for the defendant-respondent no. 2 prays for and is granted a week's time for filing  Supplementary Counter Affidavit in reply to the aforementioned Supplementary Affidavit.

Learned counsel for the defendants -appellants may file Rejoinder Affidavit by the next date fixed in the matter.
