Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents. With consent of learned counsel for the parties, this writ petition is being disposed of at this stage.

The petitioner is a duly recognized High School institution. It has been stated that there are 166 girl students registered for appearing in the High School Examination 2007. The prayer made in this writ petition is for a direction in the nature of mandamus commanding the respondents to allot the petitioner institution as self examination center or else to allot the examination center within close proximity of the petitioner institution, as per the Government Orders issued by the respondent from time to time.

The submission of learned counsel for the petitioner is that there are several institutions which are examination center  within 2 to 3 kms. of the petitioner institution whereas the examination center  for the students of the petitioner institution has been made  in Rajpati Higher Secondary Schools, Jasra, Mau which is about 14 kms. away from the petitioner institution. It has, thus, been submitted that because the students of the petitioner institution are all girls students, making of a center which is 14 kms. away from the petitioner institution is highly unreasonable and also against the provision of the Government Order dated 29.9.2006 which provides that as for as possible, the examination center  should be in the close vicinity of the institution. It has thus been urged that in case if the examination center of the petitioner institution is not made within close vicinity of the petitioner institution, the girls students would suffer irreparable loss as many of them may not even be in a position to travel 14 kms. for appearing in the examination.

Having heard learned counsel for the parties and considering the aforesaid facts and circumstances of this case, it is directed  that in case if with regard to the grievances made in this writ petition, the petitioner files a fresh comprehensive representation before respondent no.2, Joint Director of Education, Azamgarh Division, Azamgarh, alongwith a certified copy of this order, the same shall be placed by the said respondent  before the Regional Level Committee which is headed by the Commissioner, Azamgarh Division, Azamgarh and, in turn, the Regional Level Committee shall pass a reasoned and speaking order, in accordance with law, within two weeks of filing of the said representation.

With the aforesaid observations/directions, this writ petition is finally disposed of. No order as to cost.
