Standing counsel represents respondent nos. 1 to 3. Respondent no.4 is represented by Sri V.K. Singh learned counsel. Respondents are granted three weeks time to file counter affidavit. Petitioner will have three weeks thereafter to file rejoinder affidavit.
It is submitted by Sri B.D. Mandhyan learned counsel for the petitioner that there was no entry of the Gaon Sabha or any local authority over the disputed land as such proceedings under Section 122-B of the U.P. Zamindari Abolition & Land Reforms Act were not maintainable and that this objection was taken by the petitioner before the authorities below but they have not considered it.
In view of the contention the operation of the orders dated 15.1.2007 of respondent no.2 Tehsildar Jewar, District Gautam Budh Nagar and 21.8.2007 of respondent no. 1 Additional District Magistrate (Land Acquisition), Gautam Budh Nagar shall remain stayed until the next date of listing.
