HIGH COURT OF JUDICATURE AT ALLAHABAD
Court No.32
Criminal Misc. Writ Petition No.13741 of 2007
Ram Saran & others v. State of U.P. & others.
Hon'ble S. Rafat Alam, J.
Hon'ble V.D. Chaturvedi, J.
Heard learned counsel for the petitioners and also perused the impugned FIR.
The allegation made in the impugned FIR prima facie discloses commission of cognizable offence and, therefore, we do not find any reason either to interfere with the investigation or to quash the impugned FIR.
The writ petition is accordingly dismissed in limine. However, it would be open to the petitioners to apply for bail in case crime no.415 of 2007, under Sections 147, 148, 149, 332, 353, 427, 323, 504, 506 & 342 IPC and Section 3 (1) (x) of the SC & ST Act and Section 7 of the Criminal Law Amendment Act, Police Station Khandauli, District Agra. We have no doubt that the same would be considered and disposed of expeditiously.
