Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for quashing the order dated 20th July, 2007 passed by the Motor Accident Claims Tribunal rejecting the application of the petitioner for recalling of the witness. Before the Motor Accident Claims Tribunal Upadhyay Ram appeared and he was also cross-examined by the petitioner After the cross-examination was over an application has been filed for recalling the witness. The Motor Accident Claims Tribunal has held that Upadhyay Ram appeared in the witness box and he was fully cross-examined by the petitioner hence on the application of the petitioner the witness cannot be recalled. I do not find any error in the order passed by the Motor Accident Claims Tribunal. No ground to interfere made out.
The writ petition is dismissed.
