Civil Misc. Application No.211032 of 2007 has been filed on behalf of the defendants-appellants through S/Shri A.K. Rai and Vishnu Kumar Singh, learned counsel for the defendants-appellants.

It is, interalia, prayed that the Second Appeal be dismissed as not pressed.

An affidavit, sworn on 2.9.2007 by Pradeep Tyagi, stated to be member and parirokar of the defendant-appellant-Gaon Sabha, has been filed in support of the aforementioned Application.

Shri Vishnu Kumar Singh, learned counsel for the defendants-appellants submits that in view of the averments made in the aforementioned Application and its accompanying affidavit, the defendants-appellants do not want to press the Second Appeal, and the same may be dismissed as not pressed.

In view of the above, the Second Appeal is dismissed as not pressed.

Interim order, if any, is vacated.

It is made clear that no liberty is being given to the defendants-appellants to file a fresh Second Appeal on the same cause of action.
