Learned counsel for the petitioner submits that the Union Bank of India without there being any proceedings has seized the Tractor of the petitioner on 25.8.2007. Learned counsel for the petitioner submits that the petitioner has not received any citation or recovery certificate.
Considering the facts of the present case subject to petitioner's depositing an amount of Rs. 40,000/- with respondent no. 2 on or before 31st of October, 2007 the Tractor shall be released in favour of the petitioner. It is, however, directed that the Bank shall not sale or auction the tractor till the next date of listing.
Let a counter affidavit be filed by the respondents within four weeks.
