Heard counsel for the petitioner and the learned standing counsel.
By this writ petition the petitioner has prayed for quashing the recovery certificate dated 5.7.2007 issued by the Additional Labour Commissioner to the Collector, Varanasi for recovery of Rs. 20,000/- as compensation from the petitioner. Petitioner's case is that no notice was given to the petitioner before issuing the recovery certificate.
In the facts of the present case,ends of justice be served in permitting the petitioner to file objection before the Additional Labour Commissioner within four weeks from today. The respondent no. 3 may then expeditiously decide the objection preferably within a period of two months.
Till the objections are decided the recovery certificate dated 5.7.2007 shall be kept in abeyance.
With the above observations the writ petition is disposed of.
