HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble S.U. Khan, J.
Learned counsel for the respondents, who has appeared through caveat, is directed to file counter affidavit within one week. Rejoinder affidavit may be filed within three weeks thereafter.
List after two months for admission.
Unless ordered otherwise for a period of one year, petitioner shall not be evicted from the shop in dispute provided that w.e.f. September, 2007 onwards he pays rent to the landlady-respondents @ Rs.750/- per month. The rent may either directly be paid against receipt or through money-order after deducting money-order charges to the landlady-respondents or deposited before the Prescribed Authority, (in that case Prescribed Authority shall, at once, permit the landlord respondent to withdraw the amount) However, the best mode would be to deposit the rent in the Bank Account of the landlady-respondents provided that learned counsel for the landlady-respondents provides Bank Account of landlord to the learned counsel for the tenant in writing. The rent shall be paid or deposited by 7th of each succeeding month.
In case of two defaults stay order shall stand automatically vacated. Non-payment of this amount may also be a ground for dismissal of the writ petition.
