Sri S. N. Singh has put in appearance on behalf of respondent no. 4. Learned standing counsel appears for respondents No.1, 2, 3 and 5.
Petitioner's case in the writ petition is that the entire amount due under the loan taken from the respondent no. 4 was paid by the petitioner as per order of this Court dated 7.10.2005 passed in writ petition No. 63845 of 2005. Petitioner's case is that in spite of payment of entire amount the tractor of the petitioner has not yet been released by the respondent No. 4 and 5. He submits that the Sub Divisional Officer has already passed an order for release of the tractor but the same has not been released.
Let a counter affidavit be filed within four weeks. Rejoinder affidavit may be filed within one week thereafter.
List on expiry of aforesaid period.
An interim mandamus is issued to respondents No. 4 and 5 to release the tractor seized in pursuance of the Tractor Loan within a period of four weeks from the date of production of a certified copy of this order or to show cause.
