Oral Judgment (Per:H.L.Gokhale,CJ)

1. Heard Mr. Pankaj Srivastava in support of this appeal.

2. The appeal seeks to challenge the order passed by the learned Single Judge whereby he has dismissed the petition filed by the appellants herein.

3. The appellants herein are the employees in the Revenue Department in district Farrukhabad. They claim to be the President and Secretary of an Employees Co-operative Society. They have been transferred to another place within the same Tehsil. Their submission is that since they are associated with a Society of employees, they should not have been transferred. Reliance is placed on a Government communication dated 24.5.2007 and particularly clause 11 thereof which provides that for transfer of the office bearers of the Employees Union, recognized by the Government, certain procedure is required to be followed. There is no ban even as far as transfer of such persons are concerned. The learned Single Judge has therefore refused to interfere with the order of transfer.

4. In our view, there is no error in the order of the learned Single Judge. The appeal stands dismissed.
