Arshad v. State Of U.P. & Others - CRIMINAL MISC. WRIT PETITION No. - 13637 of 2007 RD-AH 15377 (12 September 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Crl. Misc. Writ Petition No. 13637 of 2007
Hon'ble Sushil Harkauli, J.
Hon'ble A.K. Roopanwal, J.
We have heard learned counsel for the petitioner.
The petitioner is not named in the first information report, therefore, there is no question of quashing the first information report or staying the arrest.
The police have stated, on a surrender application, that the petitioner is not wanted as an accused at present. He is being sought to be interrogated only as a witness in the hope that some information regarding the offence may be uncovered.
At this stage, the petitioner has approached this Court for quashing the first information report or for staying his arrest.
We are of the opinion that the petitioner's apprehension regarding arrest is either baseless or is a result of guilty conscience.
Either way, the writ petition is dismissed.
