1. Heard Mr. Anil Kumar Srivastava in support of this appeal as well as counsel for the respondents.
2. The appellant was engaged as a temporary class IV employee in a Bank. He had put in service in the respondent Bank for about 170 days, some times in the year 1975-76. He is claiming absorption on the basis of an agreement pursuance whereof a list was prepared, which may be called waiting list.
3. The counsel for the Bank points out that the list was exhausted long back and there is no subsisting list, on the basis of which any discrimination is being resorted in favour of anybody else.
4. In the circumstances, there is no substance in the petition and it was rightly dismissed by the learned Single Judge. The appeal is dismissed. Independently of this, if the appellant wants to raise industrial dispute, he may raise.
