Supplementary affidavit has been filed, which is taken on record.
Learned counsel for the landlord respondent No.3, who has appeared through caveat, is directed to file counter affidavit within three weeks. Rejoinder affidavit may be filed three weeks thereafter. Steps to serve respondent No.2 shall be taken within a week failing which the case must be listed under Chapter 12 Rule 4 of the High Courts Rules.
List for admission after three months.
Unless ordered otherwise for a period of one year, further proceedings in pursuance of order dated 20.08.2007 passed by R.C. & E.O./ A.C.M. (II), Kanpur Nagar in case No.03 of 2007 declaring vacancy shall remain stayed and petitioner shall not be evicted from the premises in dispute provided that w.e.f. September, 2007 onwards he pays rent to the landlord-respondent @ Rs.700/- per month by 7th of each succeeding month. The rent may either directly be paid against receipt or through money-order after deducting money-order charges . However, the best mode would be to deposit the rent in the Bank Account of the landlord-respondent provided that learned counsel for the landlord-respondent provides Bank Account of landlord to the learned counsel for the tenant in writing.
In case of two defaults stay order shall stand automatically vacated. Non-payment of this amount may also be a ground for dismissal of the writ petition.
