HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Mukteshwar Prasad, J.

Hon'ble K.N. Ojha, J.

Connect this appeal with Criminal Appeal No. 7893 of 2006.

We have heard Sri Abhai Saxena, learned counsel for the appellants and learned A.G.A. also. We have gone through the impugned judgment also.

Both the appeals are admitted.

The office is directed to summon the trial court record within eight weeks.

It is contended that all the three appellants were allegedly armed with firearms but they did not use their weapons. They are said to have caused simple injuries to Virendra Singh and Smt. Suman. So far as ante-mortem injuries to deceased Jaipal is concerned, the same was allegedly caused by co-accused Vishram Singh who opened fire by his country made pistol. All the three appellants were on bail during trial.

Considering the role assigned to the three appellants and the arguments advanced before us, we are inclined to release all the three appellants on bail during pendency of appeal.

Let the appellants-Ram Chandra Singh, Laljeet Singh and Ram Sevak be enlarged on bail during pendency of appeal on their executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Etah in S.T. No. 249 of 2004 State Vs. Vishram Singh and others.

All the three appellants are directed to deposit the entire amount of fine in the court below within a period of one month from today.
