The applicant alleges non-compliance of the order dated 11.9.2006 whereby the Court directed the disciplinary authority to reinstate the petitioner for the limited purposes of holding the disciplinary inquiry from the stage of reply to the charge-sheet. The Court further directed the disciplinary authority to pass appropriate orders with regard to the entitlement of the petitioner for the period from the date of the dismissal till the final order is to be passed by the disciplinary authority. It is alleged that though the inquiry has been initiated by an order dated 28.5.2007, the arrears of salary has not been released. In my opinion, no willful contempt is made out against the opposite party. It is open to the applicant to move an application before the disciplinary authority for payment of arrears as per the order of the Writ Court dated 11.9.2006.
The contempt application is dismissed.
