Heard counsel for the petitioner and the learned standing counsel.
By this writ petition the petitioner has prayed for quashing the order dated 30.6.2007 by which the petitioner's arm licence has been suspended and the petitioner has been asked to show cause as to why the licence be not cancelled. Petitioner's case is that the petitioner is licence holder of Rifle No. 742122 P.B. 315 bore and was travelling on 20.4.2007in a jeep in which the arm was there. The police intercepted the jeep and detained one Abhishek Sharma and case Crime No. 135 of 2007 was registered. Petitioner's case is that no sufficient reasons have been given within the meaning of Section 17(3) of the Arms Act for suspending the arm licence. By the impugned order the petitioner was asked to submit reply. Petitioner's case is that he has submitted reply before the District Magistrate.
In view of above, ends of justice be served in disposing of the writ petition directing the District Magistrate to take final decision expeditiously preferably within a period of three months from the date of production of a certified copy of this order . However, till the decision is taken by the District Magistrate, the petitioner shall not be asked to deposit the arm.
