The submission of the petitioners is that a resolution for grant of fishery patta has been passed in favour of the petitioners and the papers have been sent for approval before the Sub Divisional Magistrate which are pending before him but no orders have been passed thereon. The only prayer made by the counsel for the petitioners is that the Sub Divisional Magistrate, Nichlaul, Maharajganj be directed to dispose of the matter.
I have learned standing counsel and Sri N.N.verma holding brief for Sri S.K. Singh counsel for the Gaon Sabha also.
In the facts and circumstances this writ petition is disposed of with the direction to the Sub Divisional Magistrate to pass appropriate orders in respect of the matter of grant of fishery lease. It is made clear that no opinion is being expressed upon the petitioners' right and it is for the Sub Divisional Magistrate to consider all the relevant aspects and pass appropriate orders.
