Sri S. C. Srivastava has accepted notice on behalf of respondent No.5. Learned standing counsel appears for respondents No. 1 to 4.
The petitioner took a loan of Rs.2,00,000/- for purchase of tractor in the year 2000. The sale proclamation dated 18.8.2007 amounting to Rs.74,070/- has been issued against the petitioner. Learned counsel for the petitioner submits that the petitioner has deposited the amount earlier and the said amount is incorrect.
The petitioner shall make deposit of amount of Rs.30,000/- on or before 31st of October, 2007. After the said deposit the Bank shall provide statement of account to the petitioner. The petitioner thereafter shall deposit the entire outstanding amount in two quarterly instalments. The first instalment be paid on or before 31st January, 2008 and the other on or before 30th April, 2008.
In event of any default, the recovery shall stand revived. In event no attachment or auction of the immoveable property has taken place, petitioner shall not be liable to pay any recovery charges.
Subject to payment of the amount as directed above, the recovery in pursuance of the impugned notice shall remain stayed.
With the above directions the writ petition is disposed of.
