Suresh Singh & Others v. State Of U.P. Thru' Secretary (Revenue) & Others - WRIT - C No. - 42940 of 2007 RD-AH 15586 (14 September 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Janardan Sahai, J.
The petitioners' case is that they were allotted certain land by the Gaon Sabha in the year 1993. According to the petitioners counsel some of the plots, which were allotted to the petitioners had earlier been allotted to Ram Pal and Chanda, respondent nos. 6 and 7. It is conceded by the petitioners' counsel that the allotment made in favour of the respondents 6 and 7 was not cancelled. It is submitted by the petitioners' counsel that an order was passed in the case of Pyara and others Vs. Board of Revenue in Writ Petition No. 1563 of 1979, which is affecting the petitioners but that order is not binding upon the petitioners who are not parties therein. No prayer has been made for recall of that order. The prayer made in the writ petition is for a mandamus commanding the respondents not to interfere in their possession. The petitioners for such a relief have remedy of a suit in which they can raise their contentions. No ground for interference in extraordinary jurisdiction has been made out. Dismissed.
