Heard learned counsel for the petitioners.
The petitioners by means of this writ petition have challenged the order dated 23rd August 2005 (Annexure-4 to the writ petition) whereby the petitioners have been transferred to the place of their postings in the district Agra and Kanpur. Learned counsel for the petitioners, Sri H.P. Mishra, submitted that since there was an interim order, the petitioners have not been relieved despite of the fact that there is an order.
Admittedly the petitioners have been transferred. The only complaint is that transfer is in contravention of the guidelines prescribed.
In these circumstances in view of law laid down by the Hon'ble Apex Court in the case of Mrs. Shilpi Bose and others Vs. State of Bihar and others AIR 1991 SC, 532 no interference by this Court with the impugned order under Article 226 of the Constitution of India. it is always open to the petitioners to approach the higher authorities for the redressal of their grievances.
I do not find any force in the writ petition. It is accordingly dismissed.
However, it will be open to the petitioners to file representation/application to the higher authorities who shall decide the same in accordance with law expeditiously.
