The application under Order 22 Rule 47 C.P.C. has been rejected by the lower appellate court. In view of the decision of the Supreme Court in Guru Dev Singh others vs. Mehngha Ram and another, A.I.R. 1997 SC 3572, this petition is not maintainable and is dismissed.

However, it is open to the applicant to challenge the order passed by the lower appellate court after the appeal is decided in appropriate second appeal, if any.
