Rameshwar Dayal & Others v. The State Of U.P. & Others - WRIT - C No. - 44632 of 2007 RD-AH 15636 (17 September 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Janardan Sahai, J
An order of eviction in a suit under Section 202 of the U.P. Zamindari Abolition & Land Reforms Act was passed against the petitioner by the Additional District Magistrate on 27.6.2006. Against this order the petitioners filed a revision which has been dismissed. The petitioners' contention was that they have been given patta before the Zamindari Abolition by the Zamindar. This contention has not been accepted. The finding is that in response to the notice the petitioners have filed a reply stating that the patta was given to them in the year 1966, therefore the contention that they were granted patta before the Zamindari Abolition does not appear to be correct. It was also found that the petitioner did not file material to establish the source of title of his ancestors. The findings recorded are findings of fact. The order for eviction does not suffer from any illegality which may call for interference. Dismissed.
