The applicant alleges non-compliance of the order of the Writ Court dated 15.7.2007 whereby the Court restrained the respondents from interfering with the actual possession of the applicant on the land in dispute. The Court further declared the proceedings under the Ceiling Act 1976 as abated. The applicant alleges that inspite of the aforesaid order, their names has not been corrected in the revenue records.
In my view the correction of the names is a subsequent action which is required to be taken upon an application being filed by the applicant before the concerned authority. If no action is being taken by the opposite party on the application of the applicant, the appropriate remedy is elsewhere and not in a contempt jurisdiction. Since I do not find any willful disobedience of the order of the Writ Court by the opposite party, the contempt application is dismissed with the aforesaid observation.
