The petitioner was appointed on a contract basis for the post of District Programme Manager under the NPCB Project. The memorandum, by which he was appointed, is annexed as Annexure -2 to the writ petition being dated 26-3-1999.

Initially, arrangement was made for one year with the following conditions :

1. the service can be terminated with one month's notice on either side.

2. service will be terminated at the end of project period.

It was further stated that there will not be any claim for regular appointment under any circumstance.

The appointment of the petitioner was continued and expired on 30th March, 2003. The petitioner applied for extension of the period on 31-3-2003, but the said application was not forwarded to the State Government and on 6-5-2003 another person was appointed.

Challenging the order dated 6-5-2003, the petitioner approached this Court and this Court vide order dated 2-6-2003 directed for maintaining status quo.

We do not find any legal right of the petitioner to continue on the post and interfere with the appointment of someone else. Therefore, we do not find any merit in this writ petition. The writ petition is, therefore, dismissed.

The interim order stands vacated.

No order is passed as to costs.

However, passing of this order shall not affect the right of the petitioner approaching the authority concerned for payment of his salary, if any, to be paid to him for the period for which he has rendered his service.
