Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. but after four months of the alleged incident the statement of the witnesses have been recorded who stated that that the applicant was seen at the place of occurrence. There is no other evidence against the applicant. The co-accused Ram Kant Yadav and Harikesh Yadav whose case was on the same footing as the applicant have been released on bail by this court on 25.1.2007 in criminal misc. bail application no. 1490 of 2007.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Basant Yadav involved in case crime no. 241 of 2006 under Section 302 I.P.C., P.S. Tahbarpur District Azamgarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
