The petitioner is permitted to implead gaon sabha as a respondent in this petition.
It is submitted by Sri D.S.P.Singh counsel for the petitioner that an order under Section 122B of the U.P.Zamindari Abolition & Land Reforms Act was passed against Phool Chand father of respondents 3,4 and 5 for ejectment and damages on 23/1/88. Against that order a revision was filed by Phool Chand aforesaid, which was dismissed. The grievance of the petitioner is that the order dated 23.1.88 is not being implemented. It is stated that the order dated 23.1.88 has become final and is not under challenge in any proceedings. It is stated that a representation in this regard has been filed by the petitioner which is pending before the District Magistrate, Deoria,respondent no.1 and no order has been passed thereupon. In the facts and circumstances, this petition is disposed of with the direction to the respondent no.1 District Magistrate, Deoria to look into the matter and pass appropriate orders in accordance with law. It is made clear that no opinion upon the merits of the petitioner's case is being pressed by this court.
