Heard learned counsel for the applicant and the learned A.G.A. and Sri Ravesh Kumar Singh, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that according to the prosecution version the role of firing is assigned to the applicant and other co-accused persons but according to the post mortem examination report the deceased has received one gun shot wound. There is a cross version of the alleged occurrence. From the applicant side three persons have received injuries. The injuries received by the applicant side has not been explained. The co-accused Tulsi whose case was on the same footing has been released on bail by this court on 15.12.2006 in criminal misc. bail application no. 27696 of 2007.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Jagdish involved in case crime no. 375 of 2006 under Section 147,148,149,302,336,323,504I.P.C., P.S. Kasganj District Etah be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
