There is a report of the Stamp Reporter that the writ petition suffers from laches of 171 days. The submission of the petitioners is that the impugned order has been passed by the Deputy Director Consolidation without notice or opportunity of hearing to the petitioners. If that be so it is open to the petitioners to make an application for setting aside the order before by the Deputy Director Consolidation himself. As the petitioners have alternative remedy it is not a fit case for interference at this stage. In case a restoration application is filed the Deputy Director Consolidation shall consider the same and pass appropriate order. It is made clear that no opinion is being expressed by this court whether the petitioners were granted opportunity of hearing or not and it is for the Deputy Director Consolidation to consider the relevant aspect of the matter and pass appropriate order.
With these observations the writ petition is dismissed.
