Rakesh Agarwal v. O.P. Bhatt, Chairman, S.B.I. & Others - CONTEMPT APPLICATION (CIVIL) No. - 3443 of 2007 [2007] RD-AH 15996 (25 September 2007)
|
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Tarun Agarwala,J.
Heard the learned counsel for the applicant.
The applicant alleges non-compliance of the order dated 13.9.2006 passed by the Writ Court whereby it had directed the authorities to conclude the hearing on the review petition within two months from the date of the communication of a certified copy of the said order. It is alleged that in order to avoid giving an opportunity of hearing to the applicant, the opposite party decided the review petition by antedating it to 8th of September. In my opinion, assuming that the authorities had ante dated the order, thereby denying an opportunity of hearing to the applicant, nonetheless, no willful contempt, in my opinion, is made out. If the applicant is aggrieved, it is open for him to challenge the order of the authority before an appropriate forum.
The contempt application is dismissed.
