Contention of petitioners is that institution in question had been recognized in the year 1971. It fulfills each and every pre-requisite terms and conditions for bringing the same in the grant-in-aid list of the State Government under the provisions of U.P. Act No. 6 of 1979. Petitioner has further contended that as per policy of the State Government one thousand (1000) institutions have been brought on grant-in-aid list, but as far as petitioner's institution is concerned, it does not figure therein. On inquiry it revealed that petitioner's application could not be considered as khatauni and N.S.C. were missing from the file of petitioner. Petitioner submits that said documents were there in the original file of petitioner at the time of making recommendation to the State Government and they appear to have been deliberately and intentionally misplaced. Petitioners submit that after publication of list, petitioner and several other institutions raised objection. The State Government, after considering series of objections, has decided to include 100 more institutions in the grant-in-aid list. Petitioners submit that as the petitioner's institution fulfills each and every pre-requisite terms and contentions, its claim is liable to be considered.
For consideration of its claim, petitioners have already represented the matter before the Secretary, Basic Education, Government of U.P. Lucknow on 03.07.2007, as such said authority is directed that in case steps are undertaken to include 100 more institutions in grant-in-aid list, claim of petitioners also be considered on merits in its correct perspective.
With above observations and direction, writ petition is disposed.
